Terms of Use
Last updated October 12, 2026
These terms are an agreement between you and Nam Dao (“we”, “us”) for the Captivating app and becomecaptivating.com (together, “Captivating”). By using Captivating you agree to them. If you don’t agree, please don’t use it. Our Privacy Policy explains how we handle your data.
1. Who can use Captivating
You must be at least 13 years old (or the minimum age in your country) and, if you’re under 18, have a parent or guardian’s permission. You’re responsible for activity on your account.
2. What Captivating is, and isn’t
Captivating is speaking training. Scores, tiers, percentiles and feedback are automated estimates meant to help you practice. They are not professional, medical, psychological or speech-therapy advice, and they can be wrong. Results depend on your practice; we don’t promise any particular outcome.
3. Subscriptions and payments
- Some features require a paid subscription. Prices, the billing period and any free-trial length are shown in the app before you buy.
- Payment is charged to your Apple ID account when you confirm the purchase.
- Subscriptions renew automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends, at the then-current price.
- If you start a free trial, it converts to a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends. Any unused part of a free trial is forfeited when you buy a subscription.
- Manage or cancel any time in Settings → [your name] → Subscriptions on your iPhone. Canceling stops future renewals; you keep access until the end of the paid period.
- Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.
- Virtual items in the app (such as gems, streak protection or cosmetics) have no cash value and can’t be exchanged or transferred.
4. Your content
You own your recordings, transcripts and anything else you create (“your content”). You give us a limited licence to process your content only to run, secure and improve Captivating as described in the Privacy Policy. If you choose to share something publicly (for example a score card or a challenge entry), you give us permission to display it where you shared it until you remove it.
Only record yourself, or others who have agreed to be recorded. Don’t upload content you don’t have the right to use.
5. Fair use
Please don’t:
- break the law, harass anyone, or post hateful, sexual or violent content in shared or public features;
- cheat leagues or challenges, or manipulate scores, gems or streaks;
- reverse engineer, scrape, overload or interfere with Captivating, or resell it;
- use Captivating to build a competing product or to train models.
We may suspend or close accounts that break these terms.
6. Our content
Captivating, Capo, the lessons, designs and software are ours or our licensors’ and are protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial use.
7. Apple
If you got Captivating from the App Store, these terms are between you and us, not Apple, and Apple’s Licensed Application End User License Agreement also applies. Apple has no obligation to provide maintenance or support, isn’t responsible for claims about the app, and is a third-party beneficiary of these terms with the right to enforce them against you. If the app fails to conform to an applicable warranty, you may notify Apple for a refund of its purchase price, to the extent the law allows.
8. Changes and availability
We’re always improving Captivating, so features may change. We may update these terms; if a change is significant we’ll tell you in the app or by email before it takes effect. Continuing to use Captivating after that means you accept the new terms.
9. Ending
You can stop using Captivating and delete your account any time (see Support). Deleting your account doesn’t cancel an Apple subscription; cancel it in your iPhone settings.
10. Disclaimers and liability
Captivating is provided “as is” and “as available”. To the extent the law allows, we disclaim implied warranties and are not liable for indirect, incidental or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before it. Nothing in these terms limits rights you have under consumer law that can’t be excluded.
11. Disputes
Please contact us first at [email protected]; most issues are resolved quickly. These terms are governed by the laws of the place where the operator is based, without affecting mandatory consumer protections where you live.
